Peak Concepts (ABN 93 630 672 285) provides a range of digital plans, kits, and related products available via www.peakconcepts.com.au. These Terms and Conditions are provided to ensure clear understanding of the legal framework governing the use of our products and services.

1. Definitions

1.1 “Seller” means Peak Concepts.

1.2 “Buyer” means the purchaser of Goods or any person acting on behalf of the Buyer, and may also be referred to as the “Client”.

1.3 “Client” refers to the individual or entity purchasing Goods as specified in any invoice, order, or document. Where more than one Client exists, liability is joint and several.

1.4 “Goods” refers to all products supplied by the Seller, including where applicable any Services.

1.5 “Digital Goods” means products supplied in digital format, or printed copies derived from digital files where applicable.

1.6 “Services” means all services supplied by the Seller, including advice and recommendations, and may include supply of Goods where applicable.

1.7 “Price” means the agreed cost of Goods between Seller and Buyer.

1.8 “Partner” means any third-party supplier or retailer engaged by Peak Concepts to supply Goods directly or indirectly. In some cases, Goods may be shipped directly from a Partner without passing through Peak Concepts.

Partners are selected under strict criteria; however, Peak Concepts does not guarantee or warrant compliance with buyer expectations regarding quality, colour, finish, materials, specifications, voltage, or similar attributes. It is the Buyer’s responsibility to conduct appropriate research before purchase.

2. Acceptance

2.1 The Client is deemed to have accepted these Terms and Conditions upon placing an order or receiving Goods.

2.2 These Terms may only be amended in writing with Peak Concepts’ consent and prevail over any other inconsistent agreement.

3. Price and Payment

3.1 Prices are as displayed on invoices, advertisements, or listings provided by Peak Concepts.

3.2 Payments must be made via credit card or approved payment gateways on www.peakconcepts.com.au.

4. Delivery of Goods

Refer to our Shipping and Delivery Policy.

5. Risk

5.1 Risk passes to the Client upon delivery of Goods.

5.2 If delivery is requested to an unattended location, Goods are left at the Client’s risk.

5.3 Any advice or recommendations are provided in good faith based on Peak Concepts’ knowledge and experience, and must be independently verified by the Client.

5.4 Clients are responsible for ensuring safe fabrication, assembly, and use of all Goods. Peak Concepts accepts no liability for injury, loss, or damage resulting from improper use or assembly.

5.5 Peak Concepts accepts no responsibility for damages resulting from misuse, incorrect assembly, or incorrect loading of products or designs.

6. Accuracy of Client Information

6.1 Peak Concepts relies on the accuracy of information provided by the Client and accepts no liability for errors arising from incorrect specifications or measurements.

6.2 Clients are responsible for verifying all measurements and specifications before production or ordering.

6.3 If incorrect specifications are provided and production proceeds, the Client remains responsible for acceptance of Goods.

7. Title

7.1 Ownership of Goods remains with Peak Concepts until full payment is received.

7.2 Payment is not considered complete until cleared.

7.3 Until ownership passes:

• Goods remain property of Peak Concepts
• Peak Concepts may recover Goods if unpaid
• Clients must not sell or dispose of Goods outside normal business use
• Peak Concepts may enter premises to recover Goods if necessary

8. Buyer Disclaimer

The Buyer acknowledges that they rely on their own judgment when purchasing Goods and releases Peak Concepts from liability relating to misrepresentation or misunderstanding, except where required by law.

9. Returns and Defects

10. Australian Consumer Law

Nothing in these Terms excludes rights under the Australian Consumer Law or applicable Fair Trading legislation.

11. Product Warranty

11.1 Peak Concepts will pass through any manufacturer or supplier warranties where applicable.

11.2 Due to the nature of DIY kits and digital plans, no guarantee is provided on final build outcomes.

11.3 Warranty does not cover:

• Wear and tear
• Incorrect installation
• Misuse or neglect
• Modifications or alterations
• Competitive or extreme use
• Environmental damage

11.4 Clients are responsible for ensuring suitability of Goods prior to purchase.

11.5 Designs are provided based on professional opinion and may vary depending on application.

11.6 Any modifications may void warranty coverage.

11.7 Digital goods are non-refundable once delivered or accessed, unless required by law.

12. Intellectual Property

All content, designs, trademarks, and materials remain the property of Peak Concepts unless otherwise agreed in writing.

• Personal-use plans are licensed for single use only
• Commercial licenses allow repeated use but not resale or redistribution
• Designs may not be copied, shared, or reverse engineered
• Copyright remains with Peak Concepts unless explicitly transferred

13. Default and Consequences

Peak Concepts may recover costs, suspend services, or take legal action in cases of non-payment or breach of terms. Interest and recovery costs may apply to overdue accounts.

14. Cancellation

Orders may be cancelled before dispatch. Custom or made-to-order items cannot be cancelled once production has begun.

15. Privacy

Client information may be collected and used in accordance with applicable privacy laws for processing orders, credit assessment, and communication.

16. General

• These Terms are governed by the laws of Victoria, Australia
• Peak Concepts is not liable for indirect or consequential losses
• Force majeure events may suspend obligations
• Terms may be updated at any time

Changes to Terms

Updates will be published on www.peakconcepts.com.au and take effect immediately upon posting.
